These Terms of Use (“Terms”) govern your use of OurGym, a gym-management platform operated by EKC LLC (“we,” “us,” or “our”). OurGym includes the ourgym.app website, the OurGym web and mobile applications, and related email and SMS messaging. By creating an account or using the service, you agree to these Terms.

The Service

OurGym is an all-in-one platform that gyms use to manage memberships, billing, class scheduling, check-ins, workout programming, and member communications. Gyms (“Gyms”) subscribe to OurGym to run their business; their members (“Members”) use OurGym to manage their membership, reserve classes, and track workouts.

Eligibility

You must be at least 18 years old (or the age of majority where you live) to create an account. A Gym may add Members who are minors to its roster; the Gym is responsible for obtaining any consent required from a parent or guardian.

Accounts and Sign-In

  • OurGym uses passwordless sign-in: we send a one-time passcode to your mobile number or email address to verify your identity.
  • You agree to provide accurate information and keep your contact details up to date, and you are responsible for activity that occurs under your account.
  • Notify us promptly if you believe your account has been accessed without authorization.

Gyms and Members

Each Gym controls its own roster, pricing, plans, and policies. OurGym processes Member data on the Gym’s behalf. Questions or disputes about a membership, charge, or gym policy should be raised with your Gym first; we will assist the Gym in resolving them.

Fees and Payments

  • Gyms pay subscription fees for OurGym as agreed at sign-up.
  • Member payments (membership dues, class packs, retail purchases) are processed by Stripe on behalf of the Gym. We do not store full card numbers.
  • Fees charged by your Gym are set by the Gym, and refunds are governed by the Gym’s policies and applicable law.

SMS / Mobile Messaging Terms

By providing your mobile number and opting in, you consent to receive automated text messages from OurGym consisting of (1) one-time sign-in passcodes (two-factor authentication) and (2) account notifications such as class reminders, waitlist updates, billing receipts, and payment-issue alerts.

  • Consent to receive text messages is not a condition of purchasing any goods or services.
  • Message frequency varies based on your account activity.
  • Message and data rates may apply.
  • Reply STOP to any message to cancel; you will receive one final confirmation message. After opting out you can still sign in with a code sent to your email address.
  • Reply HELP for help, or contact support@ourgym.app.
  • Mobile carriers are not liable for delayed or undelivered messages.
  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose.
  • Submit false or misleading information.
  • Access another person’s account or data without authorization.
  • Attempt to disrupt, probe, or reverse-engineer the service.

Intellectual Property

OurGym, including its software, design, and content we provide, is owned by EKC LLC and protected by law. Gyms and Members retain ownership of the data they submit to the service and grant us the rights needed to operate the service on their behalf.

Disclaimer of Warranties

OurGym is provided “as is” without warranty of any kind. We do not guarantee that the service will be error-free or available at all times. OurGym is a business-management and fitness-tracking tool, not a medical service; consult a qualified professional before beginning any exercise program.

Limitation of Liability

To the fullest extent permitted by law, EKC LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of OurGym, and our total liability for any claim is limited to the amounts paid to us for the service in the twelve months before the claim arose.

Termination

We reserve the right to suspend or terminate accounts for violation of these Terms. Gyms may cancel their subscription as agreed at sign-up; Members’ access is managed by their Gym. You may close your own account at any time.

Changes to These Terms

We may update these Terms from time to time. Continued use of OurGym after changes constitutes acceptance of the updated Terms. We will notify you of material changes via email or an in-app notice.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
